1. Agreement to Terms
By accessing or using the CBank Card platform, mobile application, or any services provided by Rokutel International SA, a company incorporated in Uruguay ("CBank", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.
These Terms constitute a legally binding agreement between you and CBank. Please read them carefully.
2. Eligibility
To use CBank Card services, you must:
- Be at least 18 years of age
- Be a resident of a country where our services are available
- Not be located in, or a citizen of, any sanctioned jurisdiction
- Complete our identity verification (KYC) process
- Have the legal capacity to enter into binding agreements
- Not have been previously suspended or removed from our services
3. Our Services
CBank Card provides the following services:
- Cryptocurrency-collateralized debit card issuance
- Ability to spend cryptocurrency at merchants accepting Visa/Mastercard
- Cryptocurrency deposit and withdrawal functionality
- Account management and transaction history
Our card services are provided in partnership with licensed card issuers and payment processors. The card is issued by our partner financial institution.
4. Account Registration and Security
4.1 Account Creation
To use our services, you must create an account and complete identity verification. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using strong, unique passwords and enabling two-factor authentication
5. Card Terms
5.1 Card Issuance
Upon successful identity verification and account approval, you may request a CBank Card. Card issuance is subject to approval and may be declined at our discretion.
5.2 Card Usage
Your card may be used for purchases at merchants that accept Visa/Mastercard. Card transactions are settled using your cryptocurrency collateral. You agree to:
- Maintain sufficient collateral for your transactions
- Not use the card for illegal activities
- Report lost or stolen cards immediately
- Comply with spending limits and restrictions
5.3 Purchases & Restrictions
CBANK and Issuer reserve the right to block and terminate transactions and suspend access to your Account at any time and for any reason, including if we believe that you are using the Card or your Account for non-consumer purposes.
You may use your Account to purchase or lease goods or services by presenting your Card or providing your Card number to participating merchants that honor the Card. We will not be liable to you if any merchant cannot or will not process a purchase permitted under these Card Terms.
We may from time to time limit the type, number and dollar amount of any purchase, including any cash-like transaction, even if you have sufficient available credit to complete the purchase.
You acknowledge and agree that you have read and understood our Prohibited Activities and that you will not engage in any such activities when using the Services or the CBANK Card.
You acknowledge and agree that you will not use the CBANK Card (1) for any expense which is not an expense incurred by you; (2) for any purpose prohibited by these Card Terms; or (3) for, with, or for the benefit of any individual or entity who is blocked or sanctioned by the United States, including those identified by OFAC.
You will use all reasonable means to protect your CBANK Cards and log-in credentials from unauthorized use. You will not allow any other person or third party to use the Services or the CBANK Card on your behalf. You will immediately notify us where you know or suspect that access to your Account has been compromised or your Card has been lost, stolen, or compromised in any way.
5.4 Card Suspension
We may suspend or cancel your card at any time for suspected fraud, violation of these Terms, regulatory requirements, or other risk-related reasons.
6. Cryptocurrency and Collateral
6.1 Deposits
You may deposit supported cryptocurrencies to your CBank account. Deposits are subject to network confirmations and processing times. A deposit fee may apply.
6.2 Collateral
Your cryptocurrency deposits serve as collateral for card spending. Your available credit is determined by the value of your collateral. Cryptocurrency values fluctuate and may affect your available credit.
6.3 Withdrawals
You may withdraw available cryptocurrency subject to applicable fees and processing times. Withdrawals may be delayed for security verification.
7. Fees
CBank Card services are subject to fees including but not limited to:
- Deposit fees
- Card issuance fees
- Transaction fees
- ATM withdrawal fees
- Currency conversion fees
Current fees are displayed in the app and on our website. We may update fees with notice to you.
8. Prohibited Activities
You agree not to use CBank Card services for any prohibited activities. This includes, but is not limited to:
- Any illegal activity or violation of applicable laws
- Money laundering or terrorist financing
- Fraud or deceptive practices
- Circumventing sanctions or export controls
- Purchasing illegal goods or services
- Gambling and betting transactions
- Cash-like transactions (crypto purchases, money orders, wire transfers)
- Any activity that violates these Terms

9. Risk Disclosure
By using CBank Card, you acknowledge and accept the following risks:
- Volatility: Cryptocurrency values can fluctuate significantly
- Loss: You may lose some or all of your cryptocurrency value
- Regulatory: Laws and regulations may change affecting our services
- Technical: Blockchain networks and systems may experience issues
- Security: Despite our safeguards, security breaches may occur
Cryptocurrency is not legal tender, is not backed by any government, and accounts are not subject to FDIC or SIPC protections.
10. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted, secure, or error-free operation of our services.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CBANK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.
Our total liability shall not exceed the fees paid by you to CBank in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless CBank, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms, suspected fraud, regulatory requirements, or any other reason at our discretion. You may close your account at any time by contacting support.
Upon termination, you remain responsible for any outstanding obligations and may withdraw any available funds subject to applicable procedures.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Uruguay. Any disputes arising from these Terms or our services shall be resolved through binding arbitration, except where prohibited by law.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the app. Your continued use of our services after changes take effect constitutes acceptance of the modified Terms.
